When is a business responsible for your injuries and why it is sometimes difficult to find help?
There is nothing more distressing than having a nice shopping trip or night out with the family ruined because of an injury. Sometimes those injuries are caused by unsafe conditions at the very business you are patronizing. Adding insult to injury, it can then be difficult to find a competent lawyer willing to take on that business.
In Texas businesses owe you a safe place to shop, eat or play. They have invited you to their premises to make money off of your patronage. There is nothing wrong with that, but they cannot put profits ahead of your safety.
Texas law in this area is a little complicated but well settled. If you are a customer of the business, they have the obligation to take reasonable steps to remedy and/or warn you of any dangerous conditions the either knew or should have known about. Much of the litigation in this area concerns what the business “knew or should have known about”.
There are a few things you should do immediately if you are ever injured a business.
- First and foremost, if you are able to, take pictures of the condition that caused your fall.
- Ask employees in the area about the condition, why is it there, why hasn’t it been fixed. Get those employees names.
- Have an incident report done.
- Promptly seek medical treatment.
- If you are seriously injured seek legal advice early in the process.
